Terms of Service

These terms apply to every holiday lighting job we do. Festive Lights and Hook & Ladder Lights LLC are trade names of Festive Lights LLC, a Texas limited liability company (“we,” “us,” “our”).

When you approve a quote, pay a deposit, or let us install, you agree to these terms. We kept them short. Please read them before you book.

1Your quote

Your approved quote or invoice sets the scope of work, the price, the deposit, and the install and takedown. These terms cover everything else. If your quote and these terms conflict, your quote controls.

2What’s included

We supply, install, maintain during the season, and take down the display described in your quote. Anything not listed in your quote is not included. Small differences in placement, spacing, and cord routing are a normal part of the work.

We do not do electrical work that requires a licensed electrician, change your wiring, trim trees, remove obstructions, or work on any surface we judge unsafe. Changes after you approve your quote must be agreed in writing (email or text is fine) and are billed at our current rates.

3Our lights stay ours

Unless your quote says you bought them, the lights, clips, cords, timers, wreaths, and garland we install belong to us. They are provided for the season only.

  • Please don’t move, change, or have anyone else work on the display.
  • You are responsible for loss or damage to our materials caused by you, your household, guests, pets, or other contractors. You are not responsible for normal wear, weather, product failure, or anything we cause.
  • Materials you supply, or ask us to store, are handled at your own risk.
  • If our service ends, please give us reasonable access to collect our materials.

4Your home and access

By booking, you confirm that your roof, gutters, fascia, trim, and other exterior surfaces are sound enough for ladders, foot traffic, and clips.

Please tell us before install about anything we can’t see, such as prior repairs, aging or brittle roofing, loose gutters, hidden wiring, irrigation, landscape lighting, or an invisible pet fence. On install day, please give us safe access, secure your pets, and have working, grounded outdoor outlets that stay powered.

If we can’t finish, or have to come back, because access, power, or conditions were not as described, the extra trip may be billed. You are responsible for following any HOA rules, deed restrictions, or local ordinances about exterior lighting.

5Scheduling and weather

Your quote gives an install-by date and a takedown window, not a fixed appointment time. We schedule by route and weather, and we will not put crews on roofs or ladders in unsafe conditions.

Delays caused by weather, unsafe surfaces, conditions at your home, supply shortages, or anything else outside our reasonable control are not a breach of our agreement. If we can’t install at all for one of these reasons, we will refund what you paid for work not done, minus the documented cost of materials already bought or made for your home. That refund is your only remedy in that case.

6Property damage

If our crew damages your property through negligence, we will make it right. We carry commercial general liability insurance.

To make a claim, tell us in writing within 10 days of the visit, and give us the chance to inspect and repair the damage before anyone else works on it.

Once someone else repairs an area, the cause can no longer be determined. We are not responsible for:

  • small marks, holes, or wear from normal clips and fasteners;
  • damage to roofing, gutters, fascia, or trim that was already old, brittle, loose, rotted, damaged, or poorly installed;
  • damage to anything you did not tell us about under Section 4;
  • damage from weather, wind, freezing, or animals; or
  • conditions that existed before we arrived.

Roofing gets brittle with age and heat, and an old roof can be damaged by any contact. If we think a surface is unsafe, we will tell you and may decline to install on it.

7Limit of liability

To the fullest extent Texas law allows, our total liability for any claim related to our services is limited to the amount you paid us for the season in which the claim arose. Neither of us is liable to the other for indirect, incidental, consequential, special, or punitive damages, lost profits, or loss of use or enjoyment.

This limit does not apply to personal injury or death caused by our negligence, to gross negligence, or to fraud. Nothing in these terms waives any right you have under the Texas Deceptive Trade Practices–Consumer Protection Act.

8Payment

  • Your install date is reserved only once we receive your deposit.
  • The balance is due as shown on your quote or invoice. Sales tax is added where we are required to collect it.
  • If a balance is unpaid, we may pause service calls. If it is still unpaid 30 days after install, we may remove the display after giving you 10 days’ written notice. You still owe the balance.
  • If we need a lawyer or collection agency to collect, you agree to pay reasonable fees and costs to the extent Texas law allows. If you win the dispute, we pay yours.

9Cancelling

If Texas law gives you a three-day right to cancel your purchase, nothing in these terms limits it. Your deposit is non-refundable.

We may cancel before install if the work can’t be done safely, your home’s condition makes it unwise, or access or payment isn’t provided. In that case we refund what you paid, minus the documented cost of materials already bought or made for your home.

10Service calls

Report an outage or problem using the phone number or email below. Telling a crew member in the field does not count as notice. We repair our own display at no charge, weather and safety permitting.

A service call is billed if the cause is on your side, such as an unpowered or switched-off outlet, a tripped breaker or GFCI, a changed timer, damage by you or someone else, or materials you supplied. Changes you request are also billed.

11Takedown and next season

We take the display down during the takedown window for the company. Each new season starts only when you accept that season’s price by approving a quote, confirming in writing, or paying a deposit. Silence is never acceptance of a price. Either of us may choose not to continue for a new season, for any reason.

12Photos and your information

We photograph our installs and may use exterior photos in our marketing without your name or address. Tell us in writing if you’d rather we didn’t, and we’ll stop.

We use your information only to provide, bill for, and communicate about our services. Gate codes, alarm codes, and access notes are shared only with the people working your job. We do not sell your information.

13Promises in writing only

Your approved quote and these terms are the full agreement between us. They replace earlier conversations, quotes, and understandings, including any arrangement made with a previous owner of this business.

No verbal promise by a crew member, salesperson, or previous owner binds us unless we confirm it in writing.

We may transfer our agreement with you to an affiliate or successor that takes on our obligations, and we will tell you if we do. If you sell your home, let us know and we will arrange removal or, with the new owner’s written agreement, transfer the service.

14Disputes

If something goes wrong, contact us first. Before either of us files a lawsuit, we will try to resolve it by talking directly, and then by non-binding mediation with the mediator’s fee split equally. Either of us may still go to justice court (small claims) or ask a court for urgent relief.

Texas law governs these terms. Any lawsuit will be filed in the county where your home is located or in Travis County, Texas. If any part of these terms is found unenforceable, it will be narrowed only as much as needed and the rest stays in effect.

15Changes to these terms

We may update these terms. Each update will be posted on this page with a new version number and effective date. The version in effect on the day you pay your deposit applies to that whole season. An update never changes the price or scope of a season you have already booked.
