1. Who we are and what this policy covers

Festive Lights LLC ("Festive Lights," "we," "us," or "our") is a Texas company that designs, installs, maintains, and removes holiday and seasonal lighting for homes and businesses in the Austin area. We also rent pre-lit wreaths and garland.

This Privacy Policy explains what personal information we collect, how we use and share it, and the choices you have. It applies to information we collect through:

  • our website, festivelightsco.com (the "Site");
  • phone calls, voicemails, and text messages to or from our business numbers;
  • email, online quote and contact forms, and social media messages;
  • our advertising on Facebook, Instagram, Google, and similar platforms; and
  • in-person estimates, installations, service calls, and takedowns.

It does not apply to third-party websites or apps we link to, or to how social media platforms handle your information on their own services. Our Terms of Service and your Service Agreement also govern your relationship with us; if they conflict with this policy on how we handle your information, this policy controls.

We do not sell your personal information.

Information we collect automatically

When you visit the Site or interact with our ads, we and our service providers may collect your IP address, browser and device type, pages viewed, referring site, approximate location (city or ZIP level, from your IP address), the date and time of your visit, and which ad or link brought you to us. See Section 5 for cookies and pixels.

Information we create or receive from others

  • Photos and measurements of the exterior of your property, taken during estimates, installation, service calls, and takedown (see Section 8).
  • Call recordings and transcripts, where calls are recorded (see Section 4).
  • Lead information from advertising platforms, such as name, phone, and email you submit through a Facebook or Instagram lead form.
  • Referral information from a neighbor, customer, or partner who refers you to us.
  • Public property information, such as satellite or street-level imagery and public records we use to measure a roofline for a quote.

We do not ask for Social Security numbers, driver's license numbers, or health information, and we ask that you not send them to us.

3. How we use your information

We use personal information to:

  1. Provide our services: prepare quotes and designs, schedule and perform installation, service calls, and takedown, store your lights between seasons, and deliver and pick up rentals.
  2. Communicate with you: answer questions, confirm appointments, send weather and schedule updates, send invoices and receipts, and send renewal notices for the next season.
  3. Process payments: collect deposits and balances, issue refunds, and prevent fraud.
  4. Market our services: send offers and seasonal reminders (you can opt out at any time by replying STOP to a text or clicking "unsubscribe" in an email), and show you relevant ads online (see Section 5).
  5. Improve our business: understand which ads and services work, train our staff, check call quality, and plan routes and inventory.
  6. Protect people and property: keep records of installation and removal condition, investigate damage claims, secure our systems, and enforce our agreements.
  7. Meet legal obligations: keep tax, sales tax, and business records, and respond to lawful requests.

We use access information, such as gate and alarm codes, only to reach and work on your property for your job.

4. Calls, text messages, and recordings

Text messages. If you give us your mobile number and agree to receive texts, we may text you about quotes, appointments, scheduling and weather changes, invoices and payments, and service follow-up. If you separately agree to marketing texts, we may also send seasonal offers and reminders. Message frequency varies. Message and data rates may apply. Reply STOP to opt out at any time, or HELP for help. Agreeing to marketing texts is never a condition of buying from us.

No sharing of mobile information. We do not sell, rent, or share your mobile phone number or text-messaging opt-in consent with third parties or affiliates for their marketing or promotional purposes. We share mobile information only with service providers that help us send messages and run our phone system, and only to provide that service to us. Text-messaging originator opt-in data and consent are never shared with any third party.

Phone calls. Calls to our business numbers may be answered by an automated, AI-powered answering assistant when our team is unavailable. The assistant collects your name, number, and the reason for your call, and passes that to our team so we can call you back. It does not take payments.

Recording. Calls to and from our business numbers may be recorded and transcribed for quality, training, and record-keeping. We will tell you at the start of a call when it is recorded. If you do not want to be recorded, tell us and we will call you back on an unrecorded line or communicate by email or text instead.

5. Cookies, pixels, and advertising

The Site uses cookies and similar technologies, including the Meta Pixel and Google tags, to keep the Site working, measure traffic, and see which ads lead to quote requests. These tools may let Meta, Google, and similar companies collect information about your visit and combine it with information they already have about you, under their own privacy policies.

Advertising audiences. We may upload the email addresses or phone numbers of past customers and leads to advertising platforms in a hashed (scrambled) form, to show ads to people who already know us, to avoid showing ads to them, or to reach people with similar interests. The platforms match the hashed data against their own users and do not give us information about who matched.

Your choices. You can:

  • block or delete cookies in your browser settings (some Site features may not work);
  • change your ad preferences in your Facebook and Google accounts;
  • opt out of interest-based ads from participating companies at optout.aboutads.info; and
  • ask us to leave your contact information out of advertising audiences going forward.

Our Site does not currently respond to browser "Do Not Track" signals. Where required by law, we honor Global Privacy Control signals as an opt-out of targeted advertising for that browser.

6. How we share your information

We share personal information only as described below.

We do not sell personal information, and we do not share it with third parties for their own marketing.

7. Payments

Card and bank payments are processed by third-party payment processors, such as Stripe and our field-service software's payment service. Your full card or bank account number goes directly to the processor; we do not store it on our own systems. We keep a record of the payment amount, date, method type, and the last four digits of the card or account. If you choose to save a card for future payments or automatic renewal, the processor stores it, and you can ask us to remove it at any time.

8. Photos of your property

We photograph the exterior of your property before, during, and after installation and takedown. We use these photos to plan your design, document the condition of your property and our rental items, reinstall the same design next season, and handle any damage claim.

We may also use exterior photos and videos of our work on our website, social media, and ads. We never publish your name, house number, or street address with them, and we avoid images that show a house number, license plate, or people. If you do not want your home shown in our marketing, tell us at any time, by email or text, and we will stop using it in new posts and ads and remove it from our website.

9. How long we keep it, how we protect it, and children

Retention. We keep customer records, design notes, and photos while you are a customer and for up to 3 years after your last service, so we can reinstall your design and respond to questions or claims. We keep invoices and tax records as long as tax law requires, generally 7 years. Information about people who asked for a quote but never booked is kept for up to 2 years. Call recordings are kept for up to 12 months. Access codes are deleted or overwritten when you tell us they changed or when you stop being a customer. When information is no longer needed, we delete it or make it anonymous.

Security. We use reasonable administrative, technical, and physical safeguards, including password-protected and access-controlled business systems and limiting access to the people who need it. No system is perfectly secure. If a breach affects your information, we will notify you as required by Texas law.

Children. Our services are for adults. We do not knowingly collect personal information from children under 13. If you believe a child has sent us information, contact us and we will delete it.
